Safe Harbor Provisions for Use of Orphan works for Scientific/Technical and 
Medical Literature. 

In December 2006,STM announced a policy on Orphan Works,copyright works (literary 
works,also musical works,including any accompanying works etc.) for which a prospective 
user is unable to indenufy,locate and contact the legitimate holder of thr relevant rights 
("copyright owner") for the purpose of obtaining permission to use such work. 

Recently the foundation documents send by post to Cdbaby, address 5925 NE 
Ave,Portland,OR 972 18-2891, US A. The (new) company Audio-Rarities in the 
Netherlands and Intermediary Foundation of the Universal Declaration of Human Rights 
also from the Netherland , "Cdbaby" to sell Compact disc and / Mp3 / or records over the 
intemet,and in internet shops as "I-Tunes" etc.Cdbaby ask for a written document from 
the first release of the owner of a old record (moral right) Bill Forrest narrator and Mary Jo 
Devlin back stage, Audio Rarities LPA 2445 Title "Hitler's Inferno" in USA ,1945 end of 
the War.The foundation made research to the record company,the record and the onwner 
and Hitler's Inferno between 1994 and 1995.We have also a juridical report by a 
professionaLAlso we have written correspondence between the Buma-Stemra and the 
Foundation. The database from Harry Fox Angeny Inc in New York USA,showed no

have a written correspondence to Freistaat Bayem,Germany te owner of the original songs 
and speeches of Nazi-Germany.The Album "Hitler's Inferno have a new registration by 
the Dutch Tax.The Name Audio Rarities( form the original record) is takeover and new 
regisrered under Audio-Rarities (between Audio and Rarities a stripe by the new Audio- 
Rarities in Holland) by the Chamber of Commerce and Industry in Eindhoven,the 
Netherlands. Cdbaby ask me to show a document of permission from the owner of the 
record by Fts first release in 1945, USA. We attached the documents in this letter,even 
there is a new registration by the Dutch Tax in 2005 (Belasingdienst Oost- 
Brabant,Inspectie der Registratie en Successie,Po.box:901 16,Postalcode:5200MA,City:'s- 
Hertogenbosch,Country:The Netherlands), under Number: 4.516226.1. The first general 
release under the title "Hitler's Inferno" was published in November 1945,By Audio 
Rarities in the USA on 33 1/3 rpm LP (a kin or release WW2) end of the War,to memory 
of, "Yesterday Lesson",anti-fascist commentary .The original record is part of "Suzanne 
Statland Collection in Holocaust Studies" from the University of Missouri-Kansas City 
Libraries USAJfitler's Inferno and the consecutive tragedies indicates man's inability to 
control the destructive impulses of paranoid dictators like Hitler,Stalin,Pol Pot .When the 
first news of the concentration camps began to be broadcast in May 1 94S, the sense of 
outrage was considerable whwn one thinks of the murder and destruction. "It must never 
happen again in the civilized worid".The Title Hitler's Inferno, in words,in music 1932- 
1945, Marching songs of Nazi Germany,LPA 2445,the record content:

The statement sets out five principles to be followed by users of orphaned works: 

1 . A reasonable diligent rearch should be undertaken to find the copyright owner, 

2. The user of an orphan work must provide a clear and adequate attribution to the 
copyright owner;

3. If the copyright owner reapears,the owner should be resonable remunerated or 
appropriate restitution should be made; 

4. If injunctive relief is available against the use of a previously orphaned work,the 
injunctive relief should take into account the creative efforts and investment made 
in good faith by the user of the work; 

5. The use of orphaned work is non-exclusive.

Conseqently,the researcher is all to often constrained or suppressed ,manipulating, works 
minimized by governments who working to a different ideological politic and secret 
fascist agenda.The aim of this Declaration is to uphold and further the fundamental 
doctrine that scientific research must be free of latent and overt repressive influence of 
buxeaucratic,political,religious and pecuniary directives,and that scientific creation is a 
humanright no less than other such right and forlorn hopes as prouned in International and 
European convenants and International law. 



"European Commission against Racism and Intolerance (ECRI) 2008" 



ECRI encourages the Dutch authorities in their efforts to ensure that the criminal justice 
system provides an effective response to manifestations of racism and radical 
discrimination.The ECRI and the European Union believes that the Holocaust never be 
forgotten.That denial or revision of "clearly established historlical facts such as the 
Holocaust (Whose negation or reviston,denial or the gross minization) would be removed 
from the protection of Article 10 by Article 17"of the European Convention on Human 
Rights/The Court stated that "there is no doubt that,like any other remark directed against 
the Convention's underlying values,the justification of a pro-Nazi policy could not be 
allowed to enjoy the protection afford by Article 10.
